Comprehensive Advice for landlords in the areas of:

  • Landlord’s obligations
  • Drafting tenancy agreements, notices of termination, etc
  • RTB representation (see below)
  • Advice re eviction of tenants, overholding, and recovery of rent arrears.
  • Enforcement of RTB Adjudication / Tribunal Determination Orders in the District Court.

Advice for tenants in the areas of:

  • Tenant’s rights
  • Review of tenancy agreements
  • Review of rent review provisions
  • Advising tenants in respect of their rights to a Part IV tenancy (renewal of the tenancy), retention of deposits, and validity of termination notices.

We also offer advice for neighbours and third parties affected by a rented dwelling

Residential Tenancies Board representation & District Court enforcement of Determination Orders:

  • Advice referring a dispute to the RTB/applying on behalf of the landlord/tenant
  • Following the referral to the RTB, there is a two-stage dispute process:-
  • (a) Mediation or Adjudication Hearing
  • (b) Tribunal Hearing (if Adjudication Determination Order is appealed)
  • Once you have obtained the Determination Order, attending to enforcement in the District Court to get Orders for Possession, rent arrears, costs, etc.
  • Once you have obtained the necessary District Court Orders and the other party is still not compliant, we can instruct the Sheriff to obtain possession (where there is over holding) and seize goods (where there is a monetary order).

Types of disputes referred to Residential Tenancies Board:

Some examples of disputes referred to the Residential Tenancies Board (RTB) are as follows:

  • Breach of the landlord’s obligations
  • Breach of tenant’s obligations
  • Disputes re rent and rent reviews
  • Damage to the property
  • The validity of termination notices
  • Retention of deposits
  • Overholding
  • Rent arrears
